The High Office Worker: The impact of marijuana legalization on employers in non-safety sensitive environments
The imminent legalization of marijuana has provoked a lot of discussion about the impact on the 'safety-sensitive workplace' but there has been comparatively little discussion on the impact on the non-safety sensitive workplace. Although the 'high office worker' may not present an imminent safety risk, the 'high office worker' who works in a decision critical position may adversely impact your business.
This session will provide some guidance on how to prevent and address the 'high office worker'.
In this session, participants will learn about:
- The potential non-safety sensitive workplace issues that legalization will likely raise
- What are the signs of the 'high' employee?
- Basic legal principles of drug testing in the workplace.
- Does the law permit an employer to test a non-safety sensitive worker?
- Should you have a policy and what should it say?
- Hypothetical scenarios - discussion of the best way to respond.
About the Facilitator
Rick Dunlop, Partner, Stewart McKelvey
Rick Dunlop is a Partner with Stewart McKelvey's Nova Scotia Labour and Employment Group. Rick has a diverse management side labour and employment law practice in which he provides practical solutions and representation on all workplace legal issues. In particular, Rick often represents employers in human rights complaints, union certification applications in the construction and non-construction industry sectors, and wrongful dismissal actions.
Rick regularly appears before all Nova Scotia courts and labour and related tribunals including the Nova Scotia Labour Board, Supreme Court of Nova Scotia, and the Nova Scotia Court of Appeal. Rick has also successfully represented an employer before the Supreme Court of Canada in an employment law case.

Payment is due by the registration deadline or within 30 days of your registration (whichever is earlier). Payments made be made conveniently online at time of registration by Visa/Mastercard or by cheque received by the registration deadline. Cheques must be received by the registration deadline (January 2, 2018) by CPHR Nova Scotia, 84 Chain Lake Drive, Suite 103, Halifax, NS B3S 1A2. Registrations December 15th or later must be paid online at time of registration.
If paying by Visa or Mastercard, you must have the billing address exactly as it appears on the credit card statement or the transaction will be declined. This is a security feature for your protection.
A refund, less a $40 plus HST processing fee, will be issued for cancellations received in writing by December 15, 2017 at 12:00 noon. Those who make reservations and do not attend will be required to pay for the full session fee. Cancellations received in writing by 12:00 noon on December 15, 2017 will only be charged the processing fee. Substitutions are permitted up to the business day before the event (for substitutions, the registrant must advise our office of their replacement in writing by 10:00am on January 9). Member/non-member rates will be applied to the substitutions. This cancellation policy applies regardless of date of registration. Registrations after the cancellation deadline are non-refundable.
