CHRP Recertification Points: 3.0 Join HRANS and guest speaker John MacPherson, Q.C., for a half day session on current issues in labour and employment law. During this session John will review the most recent case law and provide some practical considerations. Specifically, the session will cover: Drug and Alcohol Testing - an update in regard to drug and alcohol testing which will focus on the recent Supreme Court of Canada decision in Communications, Energy and Paperworkers Union of Canada, Local 30 v. Irving Pulp & Paper Ltd. Excessive Use of Sick Leave - a review of the considerations, which an employer should take into account in determining whether it is appropriate to terminate an employee for an excessive use of sick leave. This part of the session will consider the duty to accommodate as well as the difference between frustration of contract and a wrongful termination in these circumstances. Termination for Substance Abuse - the third area of consideration will be the termination of an employee for substance abuse. While closely related to the previous topic, it raises some different issues. Violence in the Workplace/Harassement/Bullying - the final topic of the session will relate to violence in the workplace, harassment and bullying and the appropriate employer response in these situations.
