CHRP CPD Points: 3.0
HR Competency: Labour and Employee Relations
Human Rights is an important and often complex area. Employers, regardless of their intent, face significant potential liability if they do not appropriately navigate their obligations. This session will provide an overview of the Human Rights Act, including consideration of evolving protected characteristics such as family status, gender identity, and gender expression, a discussion of the risks of violating the Act, and an exploration of the complaint process. The second half of the session will provide a more in-depth discussion of the challenging duty to accommodate. It will provide practical guidance on the accommodation process, explore the elements of an undue hardship defence, and outline best practices to protect against future complaints.
Learning outcomes:
- What are an employer's obligations under the Human Rights Act?
- When is the duty to accommodate triggered and how do you meet that duty?
- What is an employer's right to medical information?
- When is an employer not required to accommodate an employee?
- What are the risk of failing to comply with the Human Rights Act?
